The Federal Office for Food Safety (BAES) is the competent authority for the enforcement of the following sectoral legislation (pursuant to Section 6 (1) of the Health and Food Safety Act): 1: Seeds Act 1997, as amended 2: Planting Material Act 1997, as amended 3: Plant Variety Protection Act 2001, as amended 4: Plant Protection Products Act 2011, as amended 5: Plant Protection Act 2011, as amended 6: Feedstuffs Act 1999, as amended 7: Fertiliser Act 1994, as amended 8: Marketing Standards Act, as amended Appeals against official decisions by the Federal Office for Food Safety may be lodged to the Federal Administrative Court. BAES is a subordinate agency of the Federal Ministry of Agriculture and Forestry, Environment and Water Management. The Federal Minister for Agriculture and Forestry, Environment and Water Management is the supreme authority (pursuant to Section 6 (2) of the Austrian Health and Food Safety Act). As an authority, BAES shall apply the laws of the General Administrative Proceedings Act pursuant to Section 6 (3) of the Health and Food Safety Act. Furthermore, BAES is a monocratic Federal authority (Section 6 (4) of the Health and Food Safety Act). In accordance with Section 6 (7) of the Austrian Health and Food Safety Act (GESG), the Federal Office for Food Safety has to publish Official Bulletins and make it accessible to the public concerned in an appropriate manner.
